VOSB and SDVOB Changes that Government Contractors Need to Know

The Veteran Owned Small Business (“VOSB”) and Service Disabled Veteran Owned Business (“SDVOB”) programs have had different eligibility requirements from the Small Business Administration (“SBA”) and the Veterans Administration (“VA”).

Over the years, many VOSBs and SDVOBs have complained about the differing compliance requirements. The National Defense Authorization Act (“NDAA”) for FY 2017 attempted to streamline things and make it easier. As part of the Act, Congress directed the VA to verify SDVOSBs and VOSBs using the SBA’s regulatory definitions regarding small business status, ownership, and control. The SBA and VA were directed by Congress to work together to develop joint regulations governing SDVOSB and VOSB eligibility. The VA issued a final rule effective in October 2018 eliminating its separate SDVOSB and VOSB eligibility requirements. The SBA in turn published a final rule which amended its eligibility rules.
